This privacy and cookie policy (the “Policy”) explains how „Smart Trading Software“ OOD owner of, a limited liability company, organized and existing under the laws of Bulgaria, registered with the Commercial Registry at the Registry Agency of Republic of Bulgaria,  under Unique Identification Code: 206165459, (“Grab Signals”, “Company” “we”, or “us”), collects, uses and discloses personal information through its website (“website” or “platform”) with respect to the provision of the services on the website or when you otherwise interact with us. The Policy sets out the information that the Company must provide to you for the purpose of the EU General Data Protection Regulation (“GDPR”) which is applicable as of 25 May 2018.

This Policy will be reviewed from time to time to take account of changes to our operations or practices and, further, to make sure it remains appropriate to any changes in law, technology and the business environment. Any information held will be governed by our most current Policy.

For the purposes of applicable international data protection laws, Grab Signals is the “controller” of personal information collected through the website, and Smart Trading Software is the company to contact if you have questions about the use of your personal information. The Policy also applies to personal data about each authorized representative of a client and about other persons or entities collected in the course of providing our services (such as directors of corporate clients if any).

What information do we collect?

You supply us with your personal information through the account application process, which we are required to retain. We also maintain information as a result of your website usage and cookie policy (see below). When you visit our website or use our services, we may also log your IP address, a unique identifier for your computer or other access device (such as an iPad or iPhone). For quality and control purposes we may monitor and record communications with you. Generally, this information is obtained when you agree to register as a customer and use our services. You also consent to us transferring your information, for the above purposes, to countries or jurisdictions which may not provide the same level of data protection as Republic of Bulgaria.

Confidentiality and Personal Data Protection

⇒  We may collect client information directly from you or from other persons including, for example, the credit reference agencies, fraud prevention agencies, banks, other financial institutions, third authentication service providers and the providers of public registers.

⇒  Client information which we hold is to be treated by us as confidential and will not be used for any purpose other than in connection with the provision, administration and improvement of the services on the website, anti-money laundering and due diligence checks, for research and statistical purposes and for marketing purposes. Information already in the public domain, or already possessed by Grab Signals without a duty of confidentiality will not be regarded as confidential.

⇒  Grab Signals has the right to disclose client information (including recordings and documents of a confidential nature) in the following circumstances:

  Where required by law or a court order by a competent court.
⟩  Where requested by regulatory authority having control or jurisdiction over Grab Signals or the client or their associates or in whose territory Grab Signals has clients.
  To relevant authorities to investigate or prevent fraud, money laundering or other illegal activity.
  To credit reference and fraud prevention agencies, third authentication service providers, banks and other financial institutions for credit checking, fraud prevention, anti-money laundering purposes, identification or due diligence checks of the client. To do so they may check the details the client supplied against any particulars on any database (public or otherwise) to which they have access. They may also use client details in the future to assist other companies for verification purposes. A record of the search will be retained by Grab Signals.
  To our professional advisors provided that in each case the relevant professional shall be informed about the confidential nature of such information and commit to the confidentiality herein obligations as well.
  To other service providers who create, maintain or process databases (whether electronic or not), offer record keeping services, email transmission services, messaging services or similar services which aim to assist Grab Signals collect, store, process and use client information or get in touch with the client or improve the provision of the services on the platform.
⟩  To other service providers for statistical purposes in order to improve Grab Signals’s marketing, in such a case the data will be provided in an aggregate form.
  To market research call centers that provide telephone or email surveys with the purpose to improve the services of Grab Signals, in such a case only the contact details data will be provided.
⟩  Where necessary in order for Grab Signals to defend or exercise its legal rights to any court or tribunal or arbitrator or Ombudsman or governmental authority.
⟩  At the client’s request or with the client’s consent.
  To successors or assignees or transferees or buyers, within ten business days prior written notice to the client.
  If the client is a natural person, Grab Signals will use, store, process and handle personal information provided by the client in connection with the provision of the services, in accordance of the GDPR and the Bulgarian Data Protection Act and Grab Signals is obliged to supply the client, on request, with a copy of personal data which it holds about the client (if any).

⇒  By entering into this Agreement, the client will be consenting to the transmittal of the client’s personal data outside the European Economic Area, according to the provisions of GDPR for the reasons specified above.

⇒  Telephone conversations (if any) between the client and Grab Signals may be recorded and kept by Grab Signals and recordings will be the sole property of Grab Signals.

⇒  The Client accepts that the Company may, for the purpose of administering the terms of the Agreement, from time to time, make direct contact with the client by telephone, fax, email, or post.


When we process your personal data we will only do so in the following situations:

⇒  Entering into and performing the services on the website: If you have an account or have registered on the website, our legal basis for processing your personal information is that it is necessary for the performance of service to you. With respect to an account, this includes facilitating access to our platform, processing payments, etc.

⇒  For other justifiable grounds, including legal obligation and legitimate interests: We process your personal information where necessary to comply with legal and regulatory obligations we are under, and also where it is necessary for legitimate interests we have in conducting our business. These include without limitation:

  Analyzing and continually improving the Site and our services and helping us pilot test versions of the Site internally to develop new features and ensure the efficient running of website’s services.
